General conditions of participation for competitions of the Philharmonie Salzburg - hereinafter "Organizer"

1. Eligible / Participation
By participating in the competition, the general conditions of participation are expressly recognized.
Employees of the Philharmonie Salzburg are excluded from participation. If the organizer becomes aware of technical manipulations or any other violation of these conditions of participation, he will exclude the participant from the competition. Technical manipulation includes multiple registrations by a person, participation via a competition service or similar automated collective participation services. In these cases, the prize can also be withdrawn retrospectively and a replacement winner can be drawn.

The start of the competition is the respective publication time. Participation is only possible up to the specified draw time. Please refer to the information on the competition for the relevant times.
In order to take part in some competitions, it is necessary for the participant to send a photo / picture or text to Philharmonie Salzburg beforehand. The following additional conditions apply to such submissions:
The photo / picture or text that is sent must not infringe any third party rights. It may therefore only be photos / images or texts that the participant has taken or created. In particular, photos may not depict people who do not agree to a depiction for this purpose, nor depict works by third parties (architecture, art, brands, etc.) whose copyrights and / or ancillary copyrights are thereby infringed and there is no permission to use them for this purpose . Photos / images or posted texts may not contain any illegal or immoral content, e.g. content that is pornographic, seditious, inhuman or in any other way contrary to the decency of all those who think cheaply and justly.
In the event of violations of these rules, the participant is specifically responsible for any legal violations. In this respect, the participant releases the Philharmonie Salzburgn from all claims by third parties, including the necessary costs of legal defense and legal prosecution.
By submitting the photo / picture / text, the participant declares that he / she agrees that the photo / picture or the text may be published on www.philharmoniesalzburg.com stating the name of the participant.
We will only use the contribution in connection with the competition. However, the participant is aware that the material sent in may also be discussed and linked via the social media (Facebook and Instagram) used by the Philharmonie Salzburgn.
For the use of the photo / picture / text by the Philharmonie Salzburg, the participant transfers the right free of charge to reproduce the photo / picture or the text without restriction in terms of time and space, to distribute it and in electronic databases (Facebook, Google image search and all of them services connected to these media), electronic data networks, telephone services, etc. and to make them accessible to a large number of users using digital or other storage and transmission technology.
The organizer reserves the right not to publish photos / pictures or other postings, or to publish them only in abbreviated or modified form, as long as this does not distort the meaning or content of the statement.

Participation after the expiry of the specified date for the draw of the prize is excluded. Decisive is the electronically logged entrance to the organizer. The organizer can not be held responsible for any technical disturbances, eg any failure of the telephone network or disturbances of the servers, which prevent a timely participation.

2. Gains / profit calculation / Liability
The price is indicated in the respective competition entry. A payment of the prize value in cash or an exchange of the prize is excluded. The profit claim is non-transferable.

Determination / acceptance of winners: In the case of participation, the winner is determined by submitting a photo / image / text, usually after the lottery procedure. In the lottery, a jury of the Philharmonie Salzburg, consisting of two employees of the Philharmonie Salzburg, will determine the winner from all the pictures / photos / texts sent. The winner will be notified in writing.
Opening / visiting times of the facilities are to be observed by the participant himself. The organizers expressly reserve the right to make changes with regard to individual services in the event program.
The legal process is excluded.

3. Liability
The Philharmonie Salzburg generally does not offer prizes provided by cooperation partners or award sponsors in its own name, but in the name of the award sponsors. In such cases, the Philharmonie Salzburg are not responsible for the timely and complete distribution of the prize or for material or legal defects or for any insolvency of the cooperation partner / prize sponsor and the resulting consequences for the competition.
Insofar as the material prize is a third party offer, the Philharmonie Salzburg, as the organizer of the competition, is not liable for non-performance or poor performance within the framework of the prizes or any damage suffered by the winner when using the service. As part of the competition, personal data will be collected from the winner and any accompanying persons.

5. Early termination of the raffle
The organizer reserves the right to change the raffle due to unforeseen circumstances without advance notice regarding the raffle components, cancel the raffle or terminate the raffle. 6. Others
The raffle is subject exclusively to the law of the Republic of Austria. Should one or more of the above clauses be or become wholly or partially void, ineffective or unenforceable, the remaining terms shall remain in effect. It is replaced by a valid clause. These terms and conditions apply to all competitions that the organizer carries out via his Facebook page at www.facebook.com/philharmoniesalzburg/. In the course of this, the organizer will only record the Facebook profile name.
The competitions on the Philharmonie Salzburg Facebook Wall are not affiliated with Facebook, Inc. or Facebook Ireland Ltd. The raffles are not sponsored, supported or organized in any way by Facebook and do not give rise to any legal claims against Facebook. All information in the context of the competitions will be provided exclusively by the Philharmonie Salzburg as the organizer.

4. Liability
