Conditions of participation

General Terms and Conditions of Participation for Competitions of the Philharmonie Salzburg - hereinafter "Organizer"

1. eligible participants/participation
By participating in the competition, the general conditions of participation are expressly recognized.
Employees of the Philharmonie Salzburg are excluded from participation. If the organizer becomes aware of technical manipulation or any other violation of these conditions of participation, it will exclude the participant from the competition. Technical manipulation includes multiple registrations by one person, participation via a competition service or similar automated collective participation services. In such cases, the prize may also be subsequently withdrawn and a replacement winner drawn.

The competition begins on the date of publication. Participation is only possible until the specified draw time. Please refer to the competition details for the relevant times.
In order to take part in some competitions, it is necessary for the participant to send a photo/image or text to Philharmonie Salzburg beforehand. The following additional conditions apply to such submissions:
The photo/image or text entry sent must not infringe any third-party rights. It may therefore only be photos/images or texts that the participant has taken or created themselves. In particular, photos may not depict persons who do not consent to being depicted for this purpose, nor may they depict works of third parties (architecture, art, brands, etc.) whose copyrights and/or ancillary copyrights are thereby infringed and permission to use them for this purpose does not exist. Furthermore, photos/images or posted texts may not contain any illegal or immoral content, e.g. pornographic, inciting hatred, inhuman or otherwise contrary to the decency of all fair-minded people.
In the event of violations of these rules, the participant is responsible for any legal violations. In this respect, the participant shall indemnify the Philharmonie Salzburg in full against all third-party claims, including the necessary costs of legal defense and prosecution.
By submitting the photo/image/text, the participant agrees that the photo/image or text may be published at www.philharmoniesalzburg.com, stating the participant's name.
The contribution will only be used by us in connection with the competition. However, the participant is aware that the submitted material may also be discussed and linked via the social media used by the Philharmonie Salzburg (Facebook and Instagram).
For the use of the photo/image/text by the Philharmonie Salzburg, the participant transfers free of charge the right to reproduce and distribute the photo/image or text without temporal and spatial restrictions and to feed and store it in electronic databases (Facebook, Google image search and all services associated with these media), electronic data networks, telephone services, etc. and to make it accessible to a large number of users in this way by means of digital or other storage and transmission technology.
The organizer reserves the right not to publish photos/images or other posted contributions, or to publish them only in a shortened or modified form, provided that this does not distort the meaning or message.
Please refer to the description of the competition to find out which specific actions are required to take part in a competition organized by the Philharmonie Salzburg.
Participation after the specified date for the prize draw is excluded. The electronically logged receipt by the organizer is decisive. The organizer cannot be held responsible for any technical malfunctions, e.g. telephone network outages or server malfunctions that prevent timely participation.

2. prizes/determination of winnings/liability
The prize will be stated in the respective competition entry. Payment of the prize value in cash or exchange of the prize is excluded. The prize is non-transferable.

Determination/acceptance of the winner: The winner will be determined by drawing lots if a photo/image/text is submitted. In the lottery procedure, a jury of the Philharmonie Salzburg, consisting of two employees of the Philharmonie Salzburg, will select the winner from all the pictures/photos/texts submitted. The winner will be notified in writing.
Opening/visiting times of the facilities are to be observed by the participants themselves. The organizers expressly reserve the right to make changes to individual services in the event program.
Legal recourse is excluded.

3. liability
Prizes provided by cooperation partners or prize sponsors are generally not offered by Philharmonie Salzburg in its own name, but in the name of the prize sponsors. In such cases, Philharmonie Salzburg is not responsible for the timely and complete distribution of the prize or for material or legal defects or for any insolvency of the cooperation partner/prize sponsor and the resulting consequences for the competition.
If the non-cash prize is offered by a third party, Philharmonie Salzburg, as the organizer of the competition, is not liable for non-performance or poor performance in connection with the prizes drawn or for any damage suffered by the winner when claiming the prize. The respective terms and conditions of the prize sponsors apply. Any warranty claims or claims for damages must be addressed by the winner exclusively to the service provider/prize sponsor.
As the organizer of the prize draw, the Philharmonie Salzburg shall only be liable for damages in connection with the prize draw caused intentionally or through gross negligence by its own employees or other vicarious agents. As the organizer of the prize draw, Philharmonie Salzburg is not liable for damages due to malfunctions of technical equipment, for delays or interruptions of transmissions or for damages in connection with participation in the prize draw.

4. data protection
As part of the competition, personal data will be collected from the winner and any accompanying persons.
We require this data for the purpose of processing the competition. In particular, the surname and first name, postal address and e-mail address of the persons concerned are collected, stored and used for this purpose. In the event of a win, the Philharmonie Salzburg as the organizer is also entitled to publish any Facebook profile picture and the name of the winner (also outside of Facebook, e.g. on the Philharmonie Salzburg website). By participating in our competitions, each participant also agrees to our data protection guidelines.

5. premature termination of the competition
The organizer reserves the right to change, cancel or terminate the competition due to unforeseen circumstances without prior notice with regard to the competition components. The latter applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons influence the regular and proper execution of the competition or make it impossible.

6. miscellaneous
The competition is subject exclusively to the law of the Republic of Austria. Should one or more of the above clauses be or become invalid, ineffective or unenforceable in whole or in part, the remaining conditions shall remain effective. They shall be replaced by a corresponding valid clause. The same applies in the event of a loophole.

General Terms and Conditions of Participation for Facebook competitions of the Philharmonie Salzburg - hereinafter referred to as "Organizer"

1 Scope of application/exemption from Facebook
These terms and conditions of participation apply to all competitions that the organizer conducts via its Facebook page at www.facebook.com/philharmoniesalzburg/. In the course of this, only the Facebook profile name is recorded by the organizer.
The competitions via the Philharmonie Salzburg Facebook wall are in no way connected to Facebook, Inc. or Facebook Ireland Ltd. The competitions are in no way sponsored, supported or organized by Facebook and do not give rise to any legal claims against Facebook. All information in the context of the competitions is provided exclusively by the Philharmonie Salzburg as the organizer.

2. eligible participants/participation
By participating in the competition, the Facebook user expressly accepts these general terms and conditions of participation.
The minimum age for participation is 18 years. Employees of the Philharmonie Salzburg are excluded from participation. Participation is only possible via personal Facebook registration (own Facebook account). If the organizer becomes aware of technical manipulation or any other violation of these conditions of participation, it will exclude the participant from the competition. Technical manipulation includes multiple registrations by one person, participation via a competition service or similar automated collective participation services. In such cases, the prize may also be subsequently withdrawn and a replacement winner drawn.

The competition begins at the time of publication on the Philharmonie Salzburg Facebook page. Participation is only possible until the specified draw time. Please refer to the competition details on the Philharmonie Salzburg Facebook page for the relevant times.
Depending on the competition, participation is possible, for example, by liking a post on the Philharmonie Salzburg Facebook page, commenting on it or writing a message to Philharmonie Salzburg as the operator of the Facebook page. In addition, the organizer sometimes also conducts polls among Facebook users to determine a winning entry, e.g. "The photo with the most likes wins.". To take part in such competitions, the participant must first post a photo/image or text on the Facebook page of the Philharmonie Salzburg. The following additional conditions apply to such postings:
The uploaded photo/image or the posted text contribution must not infringe any third-party rights. It may therefore only be photos/images or texts that the participant has taken or created themselves. In particular, photos may not depict persons who do not consent to being depicted for this purpose, nor may they depict works of third parties (architecture, art, brands, etc.) whose copyrights and/or ancillary copyrights are thereby infringed and for which no permission for use for this purpose exists. uploaded photos/images or posted texts may also not contain any illegal or immoral content, e.g. pornographic, inciting hatred, inhuman or otherwise contrary to the decency of all fair and just thinkers.

By posting the photo/image, the participant agrees that the photo/image may be published in the Facebook photo album of the Philharmonie Salzburg, stating the participant's name (or Facebook profile name).
The photo will only be used by us in connection with the competition. However, the participant is aware that posted photos/images or posted texts may also be discussed and linked via the website of the Philharmonie Salzburg and third parties in social media (in particular Facebook).
For the use of the photo by the Philharmonie Salzburg, the participant transfers free of charge the right to reproduce and distribute the photo/image without temporal and spatial restrictions and to feed and store it in electronic databases (Facebook, Google image search and all services associated with these media), electronic data networks, telephone services, etc. and to make it accessible to a large number of users in this way by means of digital or other storage and transmission technology.
The organizer reserves the right not to publish photos/images or other posted contributions, or to publish them only in a shortened or modified form, provided that the meaning or message is not distorted as a result.
The specific actions required to take part in a competition on the Facebook page of the Philharmonie Salzburg can be found in the description of the competition on the relevant pinboard.
Participation after the specified date for the prize draw is excluded. The electronically logged receipt by the organizer is decisive. The organizer cannot be held responsible for any technical malfunctions, e.g. telephone network outages or server malfunctions that prevent timely participation.

3. prizes/determination of prizes/liability
The prize will be stated in the respective competition posting. Payment of the prize value in cash or exchange of the prize is excluded. The prize is non-transferable.

Determination/acceptance of the winner: In the event of participation by uploading a photo/image or posting a text, the winner will generally be determined by drawing lots, unless other details for determining the winner have been provided on the Facebook wall, e.g. - the photo with the most "likes" wins (voting among users). A jury of the Philharmonie Salzburg, consisting of two employees of the Philharmonie Salzburg, will determine the winner from all uploaded pictures/photos or posted texts.
If it is not necessary to post your own content in order to take part, but only to "like" a post or answer a question, for example, the winner will be chosen at random.
The winners will be determined as soon as possible after the end of the competition and notified via Facebook.
Opening/visiting times of the facilities are to be observed by the participants themselves. The organizers expressly reserve the right to make changes to individual services in the event program.

4 Liability
