General Terms and Conditions (AGB)

The GTC are legally binding between the Philharmonie Salzburg/the Salzburg Children's Festival and visitors to events organized by the Philharmonie Salzburg/the Salzburg Children's Festival. Their scope of application extends to performances organized by the Philharmonie Salzburg/the Salzburg Children's Festival itself as well as to all performances for which the Philharmonie Salzburg merely sells the tickets.

1. TICKET PRICES
The prices listed in all our publications apply (excluding printing errors). In the event of deviations, the prices published in our ticket webshop apply.

2. REDUCTIONS
Reduced-price tickets can only be purchased if the conditions for a reduction are met and can be proven (e.g. by presenting a valid ID). There is no legal entitlement to reduced tickets, specific tickets or seating groups. Reduced tickets are limited to one per person. Discounts cannot be accumulated. In the event of unauthorized use of a discount, the difference to the full ticket price may be charged or the visitor(s) may be expelled from the performance. In the latter case, the purchase price will not be refunded.

2.1 Youth tickets for pupils and students
Pupils and students up to the age of 26 receive discounted tickets for all concerts organized by the Philharmonie Salzburg and Kinderfestspiele, subject to availability. Tickets must be purchased in person on presentation of a valid ID at the box office of the respective event or can also be purchased in the ticket store at https://www.philharmoniesalzburg.at/möglich.

2.2 Wheelchair spaces
Wheelchair spaces can be made available at a reduced price by telephone arrangement. Wheelchair spaces are allocated according to the priority principle.

3. CARD PURCHASE
Information on purchasing tickets is available from Monday to Friday, from 9.00 to 12.00, by telephone on +43 650 517 20 30, by e-mail to around the clock in the online ticket store at https://www.philharmoniesalzburg.at/ and at the box office of the respective event from 1 hour before the start of the performance.

3.1 Payment
If you order by telephone: The invoice will be sent to you, the tickets will be sent after receipt of payment.
If you order by e-mail: The invoice will be sent to you, the tickets will be sent after receipt of payment.
When ordering in the online ticket store: Payment by credit card, bank transfer or other common and customary payment methods.

3.2 Expiry of unpaid tickets
The entitlement to tickets ordered which have not been paid for by one week before the start of the event (i.e. credit to the account of the Philharmonie Salzburg or confirmation of the amount by the credit card company) expires.

3.3 Exclusion of postal delivery
From two weeks before the start of the event, tickets can no longer be delivered by post, but can only be purchased in the ticket store or at the box office.

3.4 Loss of card
If the card is lost, a duplicate can be produced for a processing fee of EUR 5 per reprint. The original card then loses its validity.

3.5 Discounts and promotions
When booking with a discount code, you can book discounted tickets/subscriptions depending on the promotion. Please note the validity period of the respective promotion. The discount cannot be applied to tickets already purchased or other promotions or redeemed in cash. The discount code may not be distributed via social media (e.g. Facebook, Instagram) or in any other way. Booking assistance: Select the number of tickets or desired seats in the store. Click on GO TO CHECKOUT, then on CONTINUE. At the end of the order process, enter your discount code, click on APPLY and receive your tickets.

It is the responsibility of the ticket purchaser to check the information on the ticket. In the event of any errors, please contact the staff of the Philharmonie Salzburg immediately. Later complaints can no longer be considered.

4. SPECIAL FEATURES FOR ONLINE PURCHASES
The ticket store at
https://www.philharmoniesalzburg.at/ allows you to select your preferred seat directly from the seating plan. You can then log in as an already registered user or register as a new user. When purchasing regular tickets, the ticket will be sent to you by e-mail after your payment has been received.

The ticket must be printed out and brought to the event and presented to the ushers on request or shown using a mobile ticket or PDF on a smartphone. The barcode on the ticket must be printed correctly. Copying and altering the printed ticket is prohibited. Printed tickets cannot be exchanged or returned. Payment in the ticket store is possible using the payment method you have selected. Online payment is processed via verified partner companies (Paypal, Stripe) using secure data transmission (SSL). The Philharmonie Salzburg accepts no liability for damages caused by criminal activity or manipulation by third parties.

5. SUBSCRIPTIONS
New subscriptions can also be ordered by telephone, e-mail and in the online ticket store.

5.1 Existing subscriptions
For customers with an existing subscription, we have already set up an account at philharmoniesalzburg.at or kinderfestspiele.com and stored the subscription accordingly. We offer you two convenient options.

You will be contacted by us at the start of the new season and will receive further information. Your existing seats will be reserved for you again. Once this process has been completed, you will receive an order confirmation. You can check this carefully, the purchase is NOT binding.

If you wish to extend your subscription for the coming season, please transfer the invoiced amount. If you have any questions or wish to make changes, please send us an e-mail to resp. or let us know by telephone: Mon-Fri, from 09:00-12:00 on +43 650 5172030.

We will reserve your subscription for you until April 30 of the year following your booking. If we do not receive a response by May 1, the usual dunning process (three stages) will be initiated and you will receive a payment reminder. As a subscriber, you can also cancel your subscription at any time free of charge.

If we have not received any feedback after these processes, we will cancel the subscription and the associated seats.

5.2 Transferability
You can transfer your season ticket to a third person in your name to attend individual events.

6. RETURN OF TICKETS
Redeemed tickets will not be exchanged and the purchase price will not be refunded. No compensation will be paid for tickets that have not been used or only partially used or for lost tickets. Exceptions are cases of death and serious illness, which will be treated individually in each case.

7. CANCELLATION OR CHANGE OF PERFORMANCES
If another work is performed instead of the work whose title is printed on the ticket or if the performance is canceled without replacement, customers will receive a full refund of the ticket price or a pro rata refund if an event is canceled. Refunds can also be made in the form of vouchers.

Changes to the cast and program as well as changes to starting times do not entitle the customer to return tickets. In the event of changes, the Philharmonie Salzburg will make every reasonable effort to inform the ticket purchaser (by e-mail, SMS, letter or telephone). However, there is no entitlement to information about changes to the cast and program or changes to starting times. Claims for damages against the Philharmonie Salzburg for failure to provide information are therefore invalid. It is the responsibility of ticket purchasers to inform themselves of any changes. If the performance is canceled, a replacement performance will be offered or, if this is not possible, the ticket price will only be refunded if less than half of the performance has been played at the time of cancellation.

8. HOUSE RULES
By purchasing an admission ticket, the visitor recognizes the house rules of the respective venue and submits to them. In principle, the valid admission ticket must be presented to the staff of the audience service of the respective venue upon request. Each valid admission ticket entitles the holder to attend the performance described on it. Only the seat indicated on the ticket may be taken. Admission to Philharmonie Salzburg events may be refused to persons if there is reason to fear that they will disrupt the performance or cause a nuisance to other visitors. Furthermore, admission may be refused if persons have already disregarded the general terms and conditions in previous performances. Visitors may be ejected from the current performance if they disrupt it, disturb others or have taken a seat that has not been allocated to them. In this case, the ticket price will not be refunded. The use of cell phones in the auditorium is not permitted. Food and drink may not be taken into the auditorium. Smoking is strictly prohibited.

9. IMAGE AND SOUND RECORDINGS
The making of image and sound recordings of any kind by visitors in the auditorium is not permitted. Visitors agree that photos, audio and video recordings made during events may be used for publications of the Philharmonie Salzburg or the Salzburg Children's Festival at any time and without entitlement to financial compensation and do not regard this as an infringement of their personal rights worthy of protection. The Philharmonie Salzburg always endeavors not to highlight individuals in photo and video recordings, but this may still happen in individual cases.

For performers of any kind:
Image and sound material created during rehearsals, castings, workshops, competitions and performances by performers of any kind may be published without any further consent. All rights for the use, utilization and publication of various recordings are transferred to the Philharmonie Salzburg/ Kinderfestspiele. The image and sound material may be used for illustration, advertising purposes and publication in social media.

10. DATA PROTECTION
When making a reservation or placing an order, the customer will be asked to provide his/her personal data (name, address, telephone number, e-mail address). The Philharmonie Salzburg is granted the right to store this data electronically. The same regulation also applies to the data of recipients of Philharmonie Salzburg newsletters.

The contractual partner agrees that his/her personal data, such as name, address, e-mail address and telephone number, may be processed by Elisabeth Fuchs and/or the Philharmonie Salzburg for the purpose of business processing, invoicing, internal evaluation for marketing purposes and for sending advertising material (by post and/or e-mail) for other projects and that the data may be passed on to business partners for the aforementioned purposes, insofar as this is necessary for business processing.

11. CONTENTS OF OUR PUBLICATIONS INCL. WEBSITE
The publications of the Philharmonie Salzburg contain an imprint. The use of the texts and illustrations contained therein - even in excerpts - is only permitted with the express permission of the Philharmonie Salzburg. The Philharmonie Salzburg accepts no liability for any errors or damage to its website and print media.

12. LIABILITY
The customer shall only have claims for damages resulting from injury to life, limb or health or from the breach of main contractual obligations, i.e. those whose fulfillment is necessary to achieve the purpose of the contract. Furthermore, liability is also assumed for damages caused by an intentional or grossly negligent breach of duty by Philharmonie Salzburg or its legal representatives. In the case of damages caused by vicarious agents, it should be noted that there must be a connection with the contractually owed service in order to be able to assert claims for compensation.

In the event of a breach of material contractual obligations, the Philharmonie Salzburg shall only be liable for foreseeable damage typical of the contract if this was caused by negligence, unless the customer's claims for damages are based on personal injury.

13. RIGHT OF WITHDRAWAL
The Philharmonie Salzburg does not grant any special rights of withdrawal with regard to the purchase of tickets. It should also be noted that there are no statutory rights of withdrawal within the meaning of the FAGG.

14. SPECIAL PROVISIONS AND CHOICE OF LAW
These terms and conditions are subject to Austrian law. The Philharmonie Salzburg reserves the right to amend the General Terms and Conditions. The place of jurisdiction is Salzburg.

15. EU DISPUTE RESOLUTION

16. LIABILITY FOR THE CONTENT OF THIS WEBSITE
The Philharmonie Salzburg is constantly developing the content of this website and endeavors to provide correct and up-to-date information. Unfortunately, the Philharmonie Salzburg cannot accept any liability for the correctness of all content on this website, especially for that provided by third parties. 18. EVENTS AS PART OF THE SUBSCRIPTION SERIES "MITTEN IM ORCHESTER"
The concerts in this subscription series are closed events of the Verein Philharmonie Salzburg. The purchase of a concert ticket includes a one-day membership of the Verein Philharmonie Salzburg for the day of the event. The day membership expires automatically after the respective concert or subscription series.

General terms and conditions for ordering vouchers

  1. SCOPE OF APPLICATION
    For all orders of vouchers via the website of the Philharmonie Salzburg
    (www.philharmoniesalzburg.at) or via the website of the Salzburg Children's Festival(https://www.kinderfestspiele.com), our General Terms and Conditions apply, which can be viewed at: https://www.philharmoniesalzburg.at/agb/oder https://www.philharmoniesalzburg.at/agb/
  1. CONCLUSION OF CONTRACT
    The presentation of items on our portal constitutes a binding offer to conclude a contract with the customer, which the customer accepts by placing an order. The contract for the purchase of a voucher is concluded when the customer first specifies during the ordering process whether a Print@home voucher or a voucher sent by post is desired. If the voucher is sent by post, there is an additional charge of 5 EURO. The voucher with the desired value is then placed in the shopping cart. The customer can see the total of all vouchers in the shopping cart - this allows the customer to recognize and correct any input errors before placing the order. After selecting the payment method, entering the customer's personal data and confirming these GTC, the customer can check all entries for correctness before placing the order and change them again if necessary. The customer accepts the offer by clicking on the "Order with obligation to pay" button. Subsequently, the customer will receive a contract confirmation by e-mail, in which all relevant order data is summarized.
  1. PURCHASE AND REDEMPTION OF VOUCHERS
    3.1 The purchase of vouchers via
    https://www.philharmoniesalzburg.at/ or https://www.kinderfestspiele.com/ is reserved exclusively for consumers aged 14 and over and entrepreneurs. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to a commercial or independent professional activity. The use and utilization of the website and the purchase of vouchers for commercial purposes (in particular the trade in and commercial resale of vouchers) or for purposes that serve a self-employed professional activity is not permitted. In this case, the Philharmonie Salzburg/the Children's Festival shall have the right to withdraw from the contract, whereby a processing fee in the amount of twice the contract value (voucher value) shall be agreed, payable immediately to the Philharmonie Salzburg/the Children's Festival.3 2. All relevant data must be provided completely and truthfully.3. 3. the vouchers are not personal, i.e. it is only necessary to present the voucher when redeeming it or the Print@home voucher when redeeming it at the evening/day ticket office. You can use the voucher code (visible on the voucher under "Code") to pay online at https://www.philharmoniesalzburg.at/ or https://www.kinderfestspiele.com/. It is not possible to block the voucher (e.g. in the event of loss, theft, etc.). The Philharmonie Salzburg and the Salzburg Children's Festival can therefore accept no liability for the unlawful redemption of a voucher and is not obliged to provide compensation if a voucher is lost. Cash redemption of vouchers is not possible.
  1. PRICES, PAYMENT, DELIVERY AND SHIPPING
    4.1 All prices quoted are final prices and include VAT. The vouchers ordered can be paid for up to an order value of EUR 300 using the payment methods offered. A minimum order value of 5 EURO applies.

    4.2 For the delivery of the vouchers by Österreichische Post AG, the customer must pay the shipping costs of EUR 5 stated on the portal. In the case of bank transfer, delivery will be made after receipt of the transfer amount in the specified bank account; in the case of payment by credit card, your order will be dispatched within business hours on the same day. Delivery and postal delivery of the vouchers will be made within 5 days of receipt of payment to the address stated in the order. Deliveries are only possible to addresses within Austria. Compensation for damages in the event of late or non-delivery is excluded except in cases of intent or gross negligence on the part of the Philharmonie Salzburg / Kinderfestspiele.
